Under the Landlord and Tenant Ordinance, a T&T landlord must serve a written Notice to Quit — usually one calendar month for monthly tenancies. If the tenant does not vacate, you file for possession at the Magistrates' Court of the district. Rent-controlled dwellings may involve the Rent Assessment Board. Self-help eviction, disconnecting utilities, or removing belongings is unlawful and can lead to damages against the landlord.
There is no statutory cap for decontrolled properties — the market standard is one month's rent as security plus one month in advance. The Rent Restriction (Dwelling Houses) Act only limits deposits on controlled premises below the Rent Assessment Board threshold. Deposits should be refunded within a reasonable period (typically 30 days) after vacation, less deductions for damage.
If rent is more than 30 days late, you can serve a Notice to Quit for non-payment and apply to the Magistrates' Court for possession and arrears. Orbit's arrears ledger, AI Rent Risk Score, and payment history give your attorney the documentation needed to file quickly.
